A Tale of Trade Marks

Once upon a time, a large company called "Denied Pillaging" were in the business of supplying the good medical folks of the world with a wizard system for taking super pictures. Around the same time, a little feisty company called "Centripetal Specific", who spent a long time with the good medical folks made a wizard system of their own called "SmartFracture".

So good was SmartFracture that soon they were selling lots and lots of them all over the world.Denied Pillaging were not at all happy with this! But then someone had a great idea, why shouldn't Denied Pillaging and Centripetal Specific get together and jointly market SmartFracture. For two happy years Denied Pillaging made sales of SmartFracture. Everybody was happy.

At Denied Pillaging's request, Centripetal Specific modified SmartFracture so that it would talk to Denied Pillaging's own products.

At Denied Pillaging's request, Centripetal Specific modified their web site to inform the good medical folk of all these exciting changes.

This was really working together! This was really working!

For two years all was well but unfortunately all good things come to end and Denied Pillaging and Centripetal Specific went their separate ways.

Come with me forward in time two years and hush now as as we listen to a letter fall through the letterbox of Centripetal Specific. It's a letter from Denied Pillaging's solicitors informing Centripetal Specific that they must make changes their web site! Centripetal Specific are infringing use of Denied Pillaging trade marks!

I wonder why it took two years for Denied Pillaging to make this objection.


I wonder why Denied Pillaging didn't offer up this constructive criticism during the time they were working together?


For that matter I wonder if the good medical folks are at all upset that Denied Pillaging pulled the plug on the other competitive products acquired by buying out other companies "PeeEssEye" and "Mysis"?

Oh well Centripetal Specific did not go into a spin and they modified their web pages and they go onto to make some jolly wizard new products. Not only that, but they make sure that customers who have software from "PeeEssEye" and "Mysis" are still able to access their software and all their patient data on their wholly new wizard system.
